Employees on this site were exposed to hazards including, but not limited to fall hazards.  Condition noted on or about 01/12/16. 29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.    a- Elevator shaft/roof - 535 Flushing Avenue, Brooklyn NY: A competent person did supervise or direct the scaffold's erection, alteration, etc. Employees on this site were exposed to hazards including but not limited to fall hazards when working from a prefabricated, tubular, welded framed scaffold that was missing mid/top rails, end stops, etc.  Condition noted on or about 01/12/16.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.      a- Roof - 535 Flushing Avenue, Brooklyn NY: On or about 01/12/16 an employee working from the outrigger and top of a prefabricated, tubular, welded framed scaffold's third buck (top) that was missing top/midrails as well as endstops was exposed to fall hazards (in excess of 19 feet to the floor below) when performing masonry and other related activities.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.502(d)(11): Lifelines were not protected against being cut or abraded:    a- Roof/Elevator Shaft - 535 Flushing Avenue, Brooklyn NY: On or about 01/12/16 an employee working from the top buck of a tubular welded framed scaffold was exposed to fall hazards, in excess of 19 feet to the ground surface below, when one end of their full body harness's lifeline was attached/wrapped around the unprotected edges of a steel eyebeam.        NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
