29 CFR 1926.451(e)(6)(vi): 1926.451(e)(6)(vi):  Integral prefabricated scaffold access frames being used for access had a spacing greater than 16 3/4 inches.  a- 420 Kent Avenue, Brooklyn NY: On or about 1/11/16, employees moving planks to upper levels of a prefabricated, tubular, welded framed scaffold system, and other related activities were exposed to falls (in excess of 25 feet to the ground surface below) when using the side opening in the scaffold's endframes to access and egress the walking/working surfaces.

29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds were used as a means of access or egress.  a- 420 Kent Avenue, Brooklyn NY: On or about 1/11/16, an employee was exposed to falls (in excess of 25 feet to the ground surface below) when accessing the top level of a prefabricated, tubular, welded framed scaffold by standing/climbing on the cross braces.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   a- 420 Kent Avenue, Brooklyn NY: On or about 1/11/16, company employees moving planks to upper levels of a prefabricated, tubular, welded framed scaffold system, and other related activities were exposed to falls in excess of 25 feet to the ground surface below when they were wearing full body harnesses with the lanyards attached back to the harness rather than to a proper tie off point(s).
