(a) Work site was located at 45 Waterview Blvd, Parsippany, NJ 07054.    An employee was observed working in a trench at a depth of at least 8'6" without a hard hat on to protect him from overhead hazards and falling objects.    Violation was observed on or about 1/19/2016.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.    (a) Work site was located at 45 Waterview Blvd., Parsippany, NJ 07054    An employee was observed in an unprotected trench deeper than 8 feet and approximately 6'6" wide x 7' long with shear 90 degree walls in Class B wet soil. Water was accumulating in the bottom of the trench while the employee was exposed due to a leaking water main valve. Methods of cave-in protection such as benching or shielding were not utilized.    Violation was observed on or about 1/19/2016.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    (a) Work site was located at 45 Waterview Blvd., Parsippany, NJ 07054.    Employees were exposed to a spoils pile that was located within inches from an open excavation. The spoils contained sections of asphalt roadway and rocks from the ground and could have caved in onto exposed utilities and employees.    Violation was observed on or about 1/19/2016.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.    (a) Work site was located at 45 Waterview Blvd, Parsippany, NJ 07054.    An employee was observed using a Louisville 8' Fiberglass Step Ladder that was used to access and egress a trench when the ladder was not properly set up for that purpose and the trench depth exceeded the ladders height.    Violation was observed on or about 1/19/2016.
