29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Mid Ohio Wood Recycling, Inc. - Kenton, Ohio: On or about March 15, 2016, the employer failed to implement the elements of a hearing conservation program. An employee using a pneumatic nail gun to build pallets was exposed to occupational noise at an 8-hour time weighted average of 89.1 dBA, which exceeded the OSHA action level of 85 dBA.
