29 CFR 1926.20(b)(2):  The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):         (a)   ADM Construction, LLC, 8200 Sheridan Street, Westminster, CO  80003: On or about January 14th, 2016, the employer had not ensured a competent person inspected the pump jack scaffold system on the South side of the apartment building prior to employee use. The scaffold system was missing guardrails to prevent falls, and bracing on the bottom portion of the three vertical scaffold poles. Condition exposed employees to fall hazards up to an estimated 16 feet.    (b) Prior to permitting employees to remove and install exterior siding from various apartment buildings, a competent person had not conducted an inspection of the worksite to identify overhead hazards requiring the use of hardhats.  Employees were observed working below a pump jack scaffold without hardhats.  Condition exposed employees to struck by hazards.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:     (a)   ADM Construction, LLC, 8200 Sheridan, Westminster, CO  80003: On January 14th, 2016, the employer did not ensure hardhards were available and used while employees worked below the pump jack scaffold system. Condition exposed employees to struck by hazards from falling tools and building materials.

29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:     (a)  ADM Construction, LLC, 8200 Sheridan Westminster, CO  80003: On January 14, 2016 the employer did not ensure employees were protected from fall hazards in that guardrails or other suitable fall protection was not installed on the pump jack scaffold on the south end of the building.  This condition exposed the employees to the hazard of a fall of approximately 16 feet.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary:     (a)  ADM Construction, LLC, 8200 Sheridan, Westminster, CO  80003:  On January 14th, 2016, the employer did not ensure the pump jack scaffold used to remove and replace exterior siding was secured at the top and bottom.  None of the three vertical poles were braced at the bottom.  This condition exposed employees to a fall in excess of 16 feet.
