OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an ejection/crushing hazard:    Near the entrance to the construction area: On or about January, 21, 2016, an employee was exposed to an ejection/crushing hazard, while operating a Genie Forklift, Model GTH-5519, without utilizing/wearing the seatbelt.

29 CFR 1926.451(c)(1)(iii): Ties, guys, braces, or outriggers were not installed to prevent the tipping of supported scaffolds in all circumstances where an eccentric load, such as a cantilevered work platform, was applied or was transmitted to the scaffold:   Near the auditorium stage:  On or about January 21, 2016, an employee was exposed to a fall hazard greater than 10 feet to the concrete ground below, while working from a tubular framed scaffold with a hoist attached to it and without bracing to prevent tipping.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  Near the auditorium stage:  On or about January 21, 2016, an employee was exposed to a fall hazard greater than 10 feet to the concrete ground below, while working from a tubular framed scaffold used to construct a masonry brick wall, that lacked adequate fall protection.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(1) of this chapter.    29 CPR 1910.178(1)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (1), except as permitted by paragraph (1)(5):  Near the entrance to the construction area:  On or about January 21, 2016 an employee was exposed to a struck by hazard while operating a Genie forklift, Model GTH-5519, prior to receiving training and being certified as a competent operator.
