OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    The employer is failing to protect employees from fall and crushing hazards while using personnel platforms elevated by all-terrain forklifts.  The most recent occurrence of this occurred at the job site located at 2524 N. 191st Street, Elkhorn, NE 68022 where the employer has employees being elevated using a Genie GTH-844 All-Terrain Forklift and a 5 foot by 16 foot platform.  In accordance with ANSI B56.6 2002, the platform dimensions are not to exceed the axel base by more than 10 inches and in this case, the platform extended 31 inches past the allowable limits on each side of the forklift.  This creates an issue of instability for the forklift when the platform is elevated which could cause the lift to tip or become unsteady enough to cause an employee to fall.    Among other methods, feasible and acceptable methods of abatement are:    a)  Ensure that all employees involved in the operation are trained and briefed prior to working with this equipment of the hazards involving elevating employees and stability issues involving this piece of equipment.     b)  Ensure that all employees of the company follow both the manufacturers recommendations in the operators manual and follow the ASME/ANSI B56.6 2002 Safety Standard for Rough Terrain Forklift Trucks.      c)  Ensure the platform being used by the company meets the requirements of both the manufacturers requirements and the above listed ANSI Standard.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:     The employer is failing to protect employees from fall hazards associated with working off of an unguarded work platform elevated by an all-terrain forklift.  The most recent occurrence of this was found on the job site located at 2524 N. 191st Street, Elkhorn, NE 68022 where the employer has employees installing fascia for a new residential home while standing on a work platform elevated by an all-terrain forklift without having installed a guardrail system to protect the workers from the 12 foot fall hazard.
