29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about January 26, 2016 the employer did not ensure employees were competent to operate powered industrial trucks by providing employees with the required training, exposing employees to the hazards associated with operating a powered industrial truck. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On January 26, 2016 an employee was not wearing a hard hat while working in a trench where overhead hazards existed, exposing the employee to a struck-by hazard. No abatement documentation or certification is required of this item.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On January 26, 2016 an employee was not provided with safe access/ egress to a trench, exposing the employee to the hazards associated with climbing into a four foot deep trench. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
