29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about January 26, 2016, while installing wood decking and vapor barrier material during the construction of a covered walkway, the employer did not ensure employees were protected from a fall of approximately 9 feet, 3 inches, by utilizing a guardrail system, safety net system and/or personal fall arrest system.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.     On or about January 26, 2016, the employer did not ensure a portable 8 foot step type ladder used to access an upper landing surface approximately 9 feet, 3 inches above the ground, was secured at its top and a grasping device was provided, assist employees in mounting and dismounting the ladder.
