29 CFR 1910.1048(n)(2): The employer did not provide employees with information and training on formaldehyde at the time of their initial assignment and/or wherever a new hazard from formaldehyde was introduced into their work area:    (a) On or about 1/26/16 at 1976 Haircare Inc. doing business as the Keratinbar, the employer did not train employees who were exposed to hair care products such as but not limited to K-Gloss and Rejuvenol which contain 1-5 % w/w formaldehyde.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:      a) On or about 1/26/16 at 1976 Haircare Inc. doing business as Keratinbar: Employees were exposed to chemicals such as but not limited to hair products containing formaldehyde, and were not provided with a Hazard Communication Program.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)   (a) On or about 1/26/16 at 1976 Haircare Inc. doing business as Keratinbar located at 342 W 14th Street New York, NY 10014, employees performing keratin treatments were exposed to the hazardous chemical formaldehyde in the absence of quickly accessible safety data sheets. The employer failed to keep safety data sheets quickly accessible for hazardous chemicals within the workplace.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
