OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to falling from a ladder that did not have the spreaders opened and locked.    (a)Cimpl Meats, LLC @ 1000 Cattle Drive, Yankton, SD 57078: On and prior to January 22, 2016, the employer did not ensure fiberglass ladders used by employees had the spreaders opened and locked prior to use. An employee had a stepladder leaned up against the bone cannon to reach the control panel. The ladder was not used as intended by the manufacturer. This condition exposed employees to a fall hazard.    Among other methods, one feasible method of abatement is to follow ANSI A14.5 2007, Subparagraph 9.3.1.2: 1) Self-supporting ladders shall not be used as single ladders or in the partially closed position. 2) Perform inspections and maintenance of ladders, and remove ladders from service when damaged as described in ANSI A14.5.

29 CFR 1910.212(a)(3)(ii):  Point(s) or operation of machinery were not adequately guarded to prevent employees from having any part of their body in the danger zone during the operating cycle:     (a)Cimpl Meats, LLC @1000 Cattle Drive, Yankton, CO 57078:  On and prior to January 22, 2016, the employer did not ensure employees were protected from amputation hazards while operating Biro vertical band saw, model # 3334FH-3334-4003FH. The vertical band saw is used for cutting rib bones of cows and bulls. On January 15, 2016, a fabrication department employee operating the band saw amputated his middle and ring finger on his left hand while attempting to push a rib bone through the saw without having adjusted the guard on the saw to the reasonably anticipated maximum dimension of cow or bull rib bones prior to commencing the cutting operation on a production run of cows or a production run of bulls. This condition exposed employees to the hazard of amputation while operating the saw.
