OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a) In Wildwood Grilling Production area: On January 26, 2016 employees were exposed to being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured. Plastic pipe was used in above ground locations throughout the facility to transport compressed air at 120 psi.   The employer failed to follow ASME Gas Transmission and Distribution Piping Systems ASME B31.8-2010, Section 842.3.3 which prohibits the above ground use of PVC pipe for compressed air conveyance.   Among other methods, one feasible and acceptable abatement for this hazard is to replace PVC piping and fittings with metal piping and fittings, which are rated to transport compressed air in exposed above ground locations.
