29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used:    a. Section 5 building second floor breezeway:  On or about January 22, 2016 and at times prior thereto, employees were exposed to falls greater than 6 feet in height to the ground level below, when working on at the edge of an open sided floor, while pouring concrete.    b. Section 5 building third floor breezeway:  On or about January 27, 2016 and at times prior thereto, employees were exposed to falls greater than 6 feet in height to the ground level below, when working at the edge of an open sided floor, while erecting guard rails.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. Second floor breezeway, Section 5:  On or about January 22, 2016, employees with no fall protection were exposed to falls greater than 6 feet in height to the ground level below, when working at the edge of the open sided floor, which was not provided with guard rails, while pulling a concrete hose.    b. Third floor breezeway, Section 5:  On or about January 27, 2016, and at times prior thereto, employees with no fall protection were exposed to falls greater than 6 feet in height to the ground level below, when kneeling at the edge of the open sided floor, while installing waterproofing membrane and a T-bar.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov:    On or about January 27, 2016, the employer failed to report to OSHA an in-patient hospitalization of an employee, when the incident occurred on January 22, 2016 and was not reported to OSHA until January 25, 2016.
