29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    a) On or about January 4, 2016; Front and side of the residential home (Eastside and Southside); the employees were using the scaffold braces and frame to access the working platform, 15' above the ground.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6).   a) On or about January 4, 2016; Front and side of the residential home (Eastside and Southside); the scaffold system  was located  1'-2' from  energized conductors, 110/120volts, instead of a minimum of 3'.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. 29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights   a) On or about January 4, 2016; Front and side of residential home (Eastside & Southside); employees were observed working on the top platform of a scaffold system that only had one plank exposing them to an estimated fall of 15' to ground level.   The ACE Masonry LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.451(b)(1), which was contained in OSHA inspection number 316030865, citation number 1, item number 3a and was affirmed as a final order on 4/20/2012, with respect to a workplace located at 4966 MacArthur Blvd NW Washington DC 20007.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
