29 CFR 1926.1101(e)(1): All Class I, II and III asbestos work shall be conducted within regulated areas. All other operations covered by this standard shall be conducted within a regulated area where airborne concentrations of asbestos exceed, or there is a reasonable possibility they may exceed a PEL. Regulated areas shall comply with the requirements of paragraphs (2), (3), (4) and (5) of this section. On or about November 23, 2015, subcontractor, Nelson Carlson Mechanical Contractors, Inc., did not ensure a regulated area was maintained while employees conducted demolition and gut/rehab activities on piping covered by asbestos containing thermal system insulation (Class I) at the site of Rochelle Foods located in Rochelle, IL. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1101(g)(1): Engineering controls and work practices for all operations covered by this section. The employer shall use the following engineering controls and work practices in all operations covered by this section, regardless of the levels of exposure: (i) Vacuum cleaners equipped with HEPA filters to collect all debris and dust containing ACM and PACM. (ii) Wet methods to control exposures during asbestos handling, mixing, removal, cutting, application, & cleanup. (iii) Prompt clean-up and disposal of wastes and debris contaminated with asbestos in leak-tight containers. On or about November 23, 2015, subcontractor, Nelson Carlson Mechanical Contractors, Inc., allowed employees to perform dry sweeping of asbestos dust and debris and did not require employees to use adequate engineering controls and work practices while conducting demolition and gut/rehab activities on piping covered by asbestos containing thermal system insulation at the site of Rochelle Foods located in Rochelle, IL. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1101(i)(1): The employer shall provide and require the use of protective clothing, such as coveralls or similar whole-body clothing, head coverings, gloves, and foot coverings for any employee exposed to airborne concentrations of asbestos that exceed the TWA and/or excursion limit prescribed in paragraph (c) of this section, or for which a required negative exposure assessment is not produced, or for any employee performing Class I operations which involve the removal of over 25 linear or 10 square feet of TSI or surfacing ACM and PACM. On or about November 23, 2015, subcontractor, Nelson Carlson Mechanical Contractors, Inc., did not provide or require the use of protective clothing, such as coveralls or similar whole-body clothing, head coverings, gloves, and foot coverings during work activities that required a negative exposure assessment that was not produced. Employees were conducting demolition and gut/rehab activities on piping covered by asbestos containing thermal system insulation at the site of Rochelle Foods located in Rochelle, IL. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
