Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:    (a) Shop area - On or about January 28, 2016, the Niagara Shear's actuating means, foot treadle, lacked protection to prevent actuation from falling or moving objects, or from unintended actuation of the shear.    Among other methods, one feasible and acceptable means of abatement to correct this hazard is to follow the American National Standards Institute (ANSI) B11.4-2003 (R13), "American National Standard for Machine Tools - Safety Requirements for Shears", Section 6.3.3.3.  Specifically, protect the foot control (foot treadle) to prevent actuation from falling objects, or from unintended actuation by unattended stepping onto the foot control.    No abatement certification or documentation is required for this item.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:    (a) Shop - On or about January 28, 2016, the employer did not ensure all "Affected" employees that operated the Niagara Shear were adequately trained on the purpose and use of the energy control procedure.    (b) Shop - On or about June 18, 2016, the employer did not ensure all "Authorized" employees that performed servicing and maintenance on the Niagara Shear were adequately trained to acquire the knowledge and skills required for the safe application, usage, and removal of the energy controls. (b) On or about January 28, 2016, the employer did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements, as required by the revised Hazard Communication Standard, 29 CFR 1910.1200.
