29 CFR 1926.451(f)(7):  The scaffold was erected, moved, dismantled, or altered without the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling, or alteration:      (a)  Tyche Construction at 1523 Grand Ave, Windsor, CO 80550:  On or before October 7, 2015, the exposing employer did not ensure the pump jack scaffolding was erected, moved, dismantled, or altered with the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling, or alteration, in that an Alum-A-Pole Scaffolding System, platform width 21 inches, was used in conjunction with a Werner SPJ-100 Steel Pump Jack model number 2424, platform width 14 inches.  Employees used the scaffold to install siding and soffit backing on a two-story residential home.  This condition exposed employees to fall hazards of approximately 15 feet due to the difference in platform widths at the section where the platforms adjoined.      (b)  Tyche Construction at 1523 Grand Ave, Windsor, CO 80550:  On or before October 7, 2015, the exposing employer did not ensure the pump jack scaffolding was erected, moved, dismantled, or altered with the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling, or alteration, in that an Alum-A-Pole Scaffolding System, platform width 21 inches, was used in conjunction with a Werner SPJ-100 Steel Pump Jack model number 2424, platform width 14 inches. This condition exposed employees to a trip hazard at the section where the two platform ends adjoined due to one platform being approximately 5 inches higher.

29 CFR 1926.451(g)(4)(i):  Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:    (a)  Tyche Construction at 1523 Grand Ave, Windsor, CO 80550:  On or before October 7, 2015, the exposing employer did not ensure employees working on a pump jack scaffold were protected from falls by the use of guardrails along all open sides and ends of the scaffold, in that the end-rails installed on one end extended past the end of the house, thus creating an opening of approximately 1.5 feet.  This condition exposed employees to fall hazards of approximately 15 feet.

29 CFR 1926.454(b):  Employees involved in erecting, disassembling, moving, operating, repairing, maintaining or inspecting a scaffold were not trained by a competent person to recognize any hazards associated with the scaffold in question:      (a)  Tyche Construction at 1523 Grand Ave, Windsor, CO 80550:  On or before October 7, 2015, the exposing employer did not ensure employees were provided with adequate training concerning erecting, disassembling, moving, operating, repairing, maintaining or inspecting a scaffold, in that an Alum-A-Pole Scaffolding System, platform width 21 inches, was used in conjunction with a Werner SPJ-100 Steel Pump Jack model number 2424, platform width 14 inches.  Employees used the scaffold to install siding and soffit backing on a two-story residential home.  This condition exposed employees to fall hazards of approximately 15 feet due to the difference in platform widths at the section where the platforms adjoined. Abatement Note: The training shall include the following topics, as applicable:      1)     The nature of scaffold hazards;      2)     The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question;      3)     The design criteria, maximum intended load-carrying capacity and intended use of the scaffold;      4)     Any other pertinent requirements of this subpart.      Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
