29 CFR 1910.1030(c)(1)(iv)(B): The employer's exposure control plan did not document annually the consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure: a) DuBois Continuum of Care Community Center, Inc., DBA DuBois Nursing Home - On or about January 29, 2016, the employer had not documented the annual consideration of safer medical devices, for devices currently in use at the facility. Employees had potential exposure to bloodborne pathogens intermittently throughout each day, when for instance, giving injections, initiating IVs, treating wounds, or cleaning blood or other potentially infectious material (OPIM) spills.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan: a) DuBois Continuum of Care Community Center, Inc., DBA DuBois Nursing Home - On or about January 29, 2016 , the employer had not documented, in the exposure control plan, the solicitation of input from non-managerial employees in the identification, evaluation and selection of effective engineering and work practice controls. The hospitalization occurred on or about January 23, 2016 at 12:30 PM. The hospitalization was not reported to OSHA until January 25, 2016.
