29 CFR 1910.120(q)(2)(xi): The emergency response plan did not address, to the extent not addressed elsewhere, personal protective equipment and emergency equipment: On or about January 27, 2016 the employer did not ensure that the emergency response plan addressed personal protective equipment including respiratory protection for employees re-entering the facility to identify levels of asphyxiate carbon dioxide. The facility houses 110,000 gallons of liquid carbon dioxide in a tank behind the plant that is piped in for use in refrigeration operations. The plant has experienced leaks in the carbon dioxide system in the past.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On or about January 27, 2016 the employer did not ensure that employees required to wear slip resistant footwear within the facility to prevent injury from slip and fall hazards did so within the first two weeks of work.
