OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) 3784 Opelika Road, Phenix City AL - Warehouse; On or about January 28, 2016 and at times prior thereto, the employer exposed employees to struck-by hazards in that employees were allowed to walk and work around steel storage racks which were damaged and the column base plates were not anchored to the floor. JVL Laboratories, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 986799, citation number 1, item number 1 and was affirmed as a final order on December 4, 2014, with respect to a workplace located at 3784 Opelika Road, Phenix City AL.

29 CFR 1910.106(d)(3)(ii)(b): The bottom, sides, and/or tops of wooden cabinets were not constructed of an approved grade of plywood at least 1 inch in thickness, that would prevent it from breaking down or delaminating under fire conditions: a) Maintenance Shop; On or about January 28, 2016 and at times prior thereto the employer exposed employees to fire hazards in that a Flammable Class 1B Liquid was stored in a wooden cabinet that did not meet the construction requirements of the standard. The cabinet was not made with 1 inch plywood and all of the joints were not rabbitted.
