29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation were performed by the employer without obtaining manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly. On or about 1 February 2016, two (2) forklift trucks being operated by employees to hoist slabs weighing approximately 950 pounds had been modified without obtaining prior written approval from the manufacturer, exposing employees to the hazards of being struck by falling loads. Instance a) The job fabricated boom type lifting attachment that was used on the Hyster Forklift. The total lifting capacity of the forklift and attachment was not determined prior to lifting the slabs. Instance b) The Aardwolf Forklift boom lifting attachment used on the Clark Forklift. The total lifting capacity of the forklift and attachment was not determined prior to lifting the slabs.
