29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  a)  On or about February 1, 2016 at 3017 Tri-Park Court in Appleton, employer did not instruct his employees in the proper use of fall protection equipment prior to installing decking 9.5 feet above surface level.  A rope was installed within 3 ft. of an approximately 25 ft. L open edge.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a)  On or about February 1, 2016 at 3017 Tri-Park Court in Appleton, employer failed to provide written fall protection safety training certification for employees working at heights greater than 6 ft. above surface level.  Employees did not recognize fall hazards during work at an open edge without adequate fall protection equipment.

29 CFR 1926.501(b)(2)(i):     Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.    Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a)  On or about February 1, 2016 at 3017 Tri-Park Court in Appleton, employees were installing second floor decking without fall protection equipment installed along an open edge 9.5 ft. above surface level.    The Jerry Zepnick Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1021553, citation number 01, item number 001 and was affirmed as a final order on April 20, 2015 with respect to a workplace located at Sunny Lane and Velp Avenue, Suamico, WI 54313.
