OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling to a lower level:  (a) 200 Barn - Employees worked from the roof of the barn, which had an eave height of about 12 feet, a peak height of about 30 feet, and a slope of 4 in 12, to remove snow from the south facing side of the roof.  The employees did not use any fall protection, exposing them to the hazard of falling to a lower level from the unprotected edge of the roof or through the roof or skylight panels, as occurred on or about January 27, 2016 when one of the employees did fall through a translucent, corrugated fiberglass skylight panel to the concrete floor below, sustaining injuries resulting in hospitalization.  (b) 200 Barn - Employees used a Genie S-40 self-propelled telescopic boom lift to access the roof of the barn, which had an eave height of about 12 feet, to remove snow from the south facing side of the roof.  The employees did not use a harness and lanyard attached to an anchor point in the platform of the lift, exposing employees to the hazard of falling to a lower level, on or about January 27, 2016.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
