29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, solicited input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan: a. On or about February 12, 2016, the employer solicited input from non-managerial employees such as, but not limited to, Licensed Practical Nurses (LPNs) and Registered Nurses (RN) who are potentially exposed to the occupational hazard of bloodborne pathogens in the process of administering medical injections to residents in the identification, evaluation of effective engineering and work places controls that would potentially minimize the number of injuries from exposures to contaminated sharps. The employer had not documented the solicitation in the Exposure Control Plan.
