29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:    On or about February 1, 2016, and times prior thereto, the employer had not conducted a workplace hazard assessment of activities such as but not limited to oxygen-acetylene torch cutting to determine what hazards were present and the necessary protective equipment that was needed to protect employees from those hazards.  Employees were exposed to eye, face, hand and skin burn injuries.

29 CFR 1910.252(a)(2)(iv): Cutting or welding was permitted in areas before the areas were inspected by the individual responsible for authorizing cutting and welding operations:    On or about January 25, 2016, the outside area at the back of the shop was not inspected prior to allowing employees to perform oxygen-acetylene torch cutting tasks.  Employee performed cutting tasks in proximity to an oil tank that contained a residual amount of a flammable/combustible liquid mixture.  Sparks from the cutting tasks ignited with the vapors from the tank and exposed employees to a fire and explosion hazard.

Cutting or welding shall not be permitted in the following situations:  On or about January 25, 2016, outside area at the back of the shop, employees performed oxygen-acetylene torch cutting tasks in close proximity to flammable/combustibles.  Employees performed oxygen-acetylene torch cutting tasks in proximity to an oil tank that contained a residual amount of a flammable/combustible liquid mixture. 29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA:    The employer failed to report the workplace accident that occurred on January 25, 2016 involving severe burns and overnight hospitalization, to the Occupational Safety & Health Administration.
