OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards related to damaged forklift seatbelt assemblies:    a) Loading dock - On or about February 3, 2016, a Nissan Model 30 forklift identified as #5, serial number 9N2054, featured a broken seatbelt assembly, preventing employees from being properly restrained during forklift operation.    Among other feasible means of abatement, the employer must repair seat belt assemblies when they are discovered to be damaged or inoperable during daily inspections.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:  a) Loading dock - On or about February 3, 2016, a Nissan Model 30 forklift identified as #5, serial number 9N2054, with a broken seatbelt was not removed from service by the employer.  b) Loading dock - On or about February 3, 2016, three forklifts used for loading freight had broken propane tank locator pins, but were not removed from service by the employer.

29 CFR 1910.23(e)(2): Stair rails did not consist of a top rail, intermediate rail and/or posts, with the vertical height not more than 34 inches (86.36 cm) nor less than 30 inches (76.2 cm) from upper surface of top rail to surface of tread in line with face of riser at forward edge of tread:  a) Loading dock, rear exit - On or about February 3, 2016, employees were using a six riser metal stair to access the dock area from the yard which contained a broken stair rail with top and intermediate rails that did not meet height requirements of this standard.

29 CFR 1910.23(e)(3)(iv): The anchoring of posts and framing of members for railings of all types were not of such construction that the completed structure was not capable of withstanding a load of at least 200 pounds applied in any direction at any point on the top rail:  a) Loading dock, rear exit - On or about February 3, 2016, employees were using a six riser metal stair to access the dock area from the yard which contained a broken stair rail which was not capable of withstanding a load of at least 200 pounds applied in any direction at any point on the top rail.

29 CFR 1910.303(g)(1)(i)(A): For electric equipment operating at 600 volts, nominal, or less to ground, and likely to require examination, adjustment, servicing, or maintenance while energized, the depth of the working space in the direction of access to live parts (as measured from the live parts where they were exposed or from the enclosure front or opening where they were enclosed) was less than indicated in Table S-1 of Subpart S of Part 1910:    a) Dock, Phone room - On or about February 3, 2016, the circuit breaker panels, transformer, and meter base were obstructed by materials, trash, and equipment.    b) Maintenance shop - On or about February 3, 2016, the circuit breaker panel was obstructed by tools and materials.
