29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:    (a)  On or about January 25th, 2016 and at times prior for an employee of Grotberg Electric who fell approximately 13 feet while climbing the end frames to access the scaffold platforms to perform electrical work activities in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section:      (a)  On or about January 25th, 2016 and at times prior employees of Grotberg Electric were exposed to fall hazards of approximately 13 feet while conducting electrical work activities from a scaffold system without adequate fall protection in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a)  On or about January 25th, 2016 and at times prior for employees of Grotberg Electric who were climbing end frames to access scaffold platforms in order to perform electrical work activities without adequate fall protection systems in place in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.
