29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  (a)  On or about January 25th, 2016 and at times prior employees of Mortenson Masonry were exposed to fall hazards of approximately 13 feet while installing concrete blocks on a scaffold system while climbing the end frames to access the scaffold platforms in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.  (b)  On or about January 25th, 2016 and at times prior employees of Grotberg Electric were exposed to fall hazards of approximately 13 feet while performing electrical work activities from a scaffold system while climbing the end frames to access the scaffold platforms where Mortenson Masonry was acting in the capacity of a creating employer in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level:    (a)  On or about January 25th, 2016 and at times prior employees of Mortenson Masonry were exposed to fall hazards of approximately 13 feet while installing concrete blocks on a scaffold system without adequate fall protection in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.  (b)  On or about January 25th, 2016 and at times prior employees of Grotberg Electric were exposed to fall hazards of approximately 13 feet while performing electrical work activities from a scaffold system without adequate fall protection where Mortenson Masonry was acting in the capacity of a creating employer in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.

29 CFR 1926.454(c): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer did not retrain each such employee so that the requisite proficiency is regained:   (a)  On or about January 25th, 2016 and at times prior employees of Mortenson Masonry were laying concrete block from a scaffold climbing the end frames to access the scaffold platforms and without adequate fall protection systems in place in the vicinity of 1021 11th Street North in Wahpeton, North Dakota.
