29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:    On or about 2/2/2016 at Ainsworth Institute of Pain Management PLLC located at 115 East 57th Street Suite 1210 New York, NY 10022, medical assistants perform medical procedures where they handle medical devices including but not limited to catheters and spinal needles.     (a) The employer failed to solicit input from employees about engineering controls for sharps such as but not limited to BD catheters.       (b) The employer failed to solicit input from employees on work practice controls regarding the disposal of  spinal needles used in the operating room.      NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY.

The employer failed to maintain safety data sheets for hazardous chemicals such as but not limited to Sani-Cloth Plus Germicidal Disposable Cloth and Sani-Cloth HB Germicidal Disposable Wipes. The employer failed to develop a training program to give employees information and training on the hazardous chemicals within their work areas.
