29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a- 107 Williams Street, Lakewood NJ: A company employee was exposed to struck by hazards when directing employees (while beneath them) as they performed floor truss installation using unsecured hand tools, pneumatic nailers, etc.  This directing employee was not wearing a hard hat, or any other form of personal protective equipment that would have protected their head, when directly beneath these actively working employees. Condition noted on or about 02/04/16.

29 CFR 1926.20(b)(2): Frequent and regular inspections of the job site, materials, and equipment to be conducted by a competent person designated by the employer was not provided by the employer who was responsible to initiate and maintain an accident prevention program:    a- 107 Williams Street, Lakewood NJ: A competent person did not conduct frequent and regular inspections of the jobsite.  Employees on this site were exposed to hazards including, but not limited to fall hazard and struck by hazards.  Condition noted on or about 02/04/16.    Gonzalez Miguel T/A Miguel's Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1047790, citation number 1, item number 1 and was affirmed as a final order on 04/29/15, with respect to a workplace located at 14 Glen Avenue, Lakewood NJ.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    a- 107 Williams Street, Lakewood NJ: Two employees, not utilizing any fall protection, were exposed to fall hazards of approximately 22 feet 2 inches to the ground surface below when performing roof shingle rip, tear, replace, and other related activities from a third story roof with a pitch of approximately 14 on 12.  Condition observed on or about 02/04/16.     Gonzalez Miguel T/A Miguel's Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1047790, citation number 1, item number 3 and was affirmed as a final order on 04/29/15, with respect to a workplace located at 14 Glen Avenue, Lakewood NJ.
