29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) The employer exposed employees to amputation and struck by hazards in that employees were allowed to operate the #1 shear where the area around the coiled sheet metal reel was not guarded to prevent contact with the rotating coil, spindle components and the moving strip. b) The employer exposed employees to amputation and struck by hazards in that employees were allowed to operate the #2 shear where the area around the coiled sheet metal reel was not guarded to prevent contact with the rotating coil, spindle components and the moving strip.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: a) The employer exposed employees to amputation hazards in that employees were allowed to operate the #1 shear where the point of operation was not provided with any type guarding such as an electronic eye safety circuit, two hand control, or other similar protection as required by the regulation. b) The employer exposed employees to amputation hazards in that employees were allowed to operate the #2 shear where the point of operation was not provided with any type guarding such as an electronic eye safety circuit, two hand control, or other similar protection as required by the regulation.
