OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards. WORKSITE: The employer did not ensure through visual observation, instruction and/or training that the employee involved in tree removal operations from the basket/platform of the Teupen Model TL92SJ LEO Serious 30T Spider lift at a height approximately 18 feet from the ground was wearing appropriate fall protective device at all times during the process.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were exposed to hazards by motor vehicle traffics. WORKSITE: The employees, performing tree removal operations from the ground and a vehicle mounted aerial lift basket/platform were neither provided with appropriate and adequate warning signs and/or other traffic control devices nor training to protect hazards from vehicular traffics.
