29 CFR 1910.1030(c)(1)(ii)(B):  The employer's Exposure Control Plan did not include the schedule and method of implementation for paragraphs (d) Methods of Compliance, (f) Hepatitis B Vaccination and Post-Exposure Evaluation and Follow-up, (g) Communication of Hazards to Employees, and (h) Recordkeeping, of this standard:        a) Noga Ambulance Service, Inc. -On or about February 9, 2016, and times prior thereto: Employees had potential exposure to bloodborne pathogens intermittently throughout work operations including, but not limited to, giving injections, drawing blood, initiating I.V.s, bandaging, and cleaning blood and/or OPIM spills while providing emergency services. The employer's written Bloodborne Pathogen Exposure Control Plan was not site specific. In that, the written plan did not identify items including, but not limited to:               1) The name of responsible person or department that will provide and maintain all necessary personal protective equipment (PPE), engineering controls (e.g., sharps containers), labels, and red bags as required by the standard;    2) The name of responsible person or department that will ensure that adequate supplies of personal protective equipment are available in the appropriate sizes;    3) The name of person or department who would be responsible for ensuring that the recommendations and procedures in regard to engineering controls and work practices are carried out;     4) The description of the process, literature reviewed, supplier information reviewed, and products considered for changes in engineering controls;     5) The name of the responsible person or department who will perform laundering;        6) The name of person or department who would be responsible for ensuring that warning labels are affixed or red bags are used as required if regulated waste or contaminated equipment is brought into the facility;     7) The name of the responsible person or department employees would notify if they discover regulated waste containers, refrigerators containing blood or OPIM, contaminated equipment, etc. without proper labels;     8) The name of the responsible person or department who will provide training to employees on hepatitis B vaccinations, addressing safety, benefits, efficacy, methods of administration, and availability;     9) The name and location of the health care professional responsible for administration of hepatitis B vaccinations;      10) The name of responsible person or department who would provide the employee with a copy of the evaluating health care professional's written opinion within 15 days after completion of the evaluation;     11) The name of the person employees would contact should an exposure incident occur;    12) The name of the responsible person or department that ensures that the health care professional evaluating an employee after an exposure incident are provided with the following:  A description of the employee's job duties relevant to the exposure incident, route(s) of exposure, circumstances of exposure, if possible, results of the source individual's blood test, relevant employee medical records, including vaccination status;    13) The name or job title of the person that will record all percutaneous injuries from contaminated sharps in a Sharps Injury Log.    14) The name or job title of the person responsible for ensuring that employees who have occupational exposure to bloodborne pathogens receive initial and annual training;    15) The name of person or department responsible for maintenance of the required medical records; and    16) The name of person or department responsible for ensuring employee medical records are provided upon request of the employee or to anyone having written consent of the employee within 15 working days.

29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the exposure control plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure:      a) Noga Ambulance Service, Inc. -On or about February 9, 2016, the employer had not documented the annual consideration of safer medical devices, for devices currently in use at the facility. Employees had potential exposure to bloodborne pathogens intermittently throughout work operations including, but not limited to, giving injections, drawing blood, and initiating I.V.s, while providing emergency services.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, solicited input from non-managerial employees responsible for dierct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:  a) Noga Ambulance Service, Inc. -On or about February 9, 2016, the employer had not documented, in the exposure control plan, the solicitation of input from non-managerial employees in the identification, evaluation and selection of effective engineering and work practice controls.. Employees had potential exposure to bloodborne pathogens intermittently throughout work operations including, but not limited to, giving injections, drawing blood, and initiating I.V.s, while providing emergency services.

The employer did not provide employees with information and training on the physical and health hazards of the hazardous substances to which they may be exposed.
