29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about February 9, 2016 and at times prior thereto, at or near The Waterford Apartments, 702 Green Mountain Drive, Little Rock, Arkansas, employees of Juan Rivera performed roofing construction on two story apartments, greater than 6 feet above the ground below without fall protection. This condition exposed employees to fall hazards.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. On or about February 9, 2016 and at times prior thereto, at the worksite located at or near 702 Green Mountain Drive, Little Rock, Arkansas, the employer did not provide a training program for employees who were to be continuously exposed to fall hazards while performing roofing construction on a two story apartment building. This condition exposed employees to the hazard of falling.
