29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  At the worksite located at 12452 Caspian Dr, Papillion, NE 68046 the employer is failing to protect employees from fall hazards:  Employees working on an 8 in 12 pitched residential roof performing roofing activities at heights ranging from 12.5 to 30 feet eave to ground are not provided with effective training to recognize the hazards of falling and the procedures to minimize these hazards including the need to use fall protection.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:   At the worksite located at 12452 Caspian Dr, Papillion, NE 68046 the employer is failing to protect employees from fall hazards:  Employees were observed working on an 8 in 12 pitched residential roof performing roofing activities without any type of fall protection system in use.  This exposed the employees to falls ranging between 12.5 and 30 feet from eave to ground.  Fernando Hervert Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1103117, citation number 1, item number 1 and was affirmed as a final order on 27 November 2015, with respect to a workplace located at 10354 S 124th Street, Papillion, NE 68046.

29 CFR 1926.1053(b)(1):  Where a portable ladder was used for access to an upper level landing surface and the ladder's side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  At the worksite located at 12452 Caspian Dr Papillion, NE 68046 the employer is failing to protect employees from fall hazards:  An extension ladder used for access and egress to roof deck 12.5 feet above the ground did not extend at least 3 feet above the surface being accessed.  The ladder was also not secured at its top to a rigid support.  Fernando Hervert Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1103117, citation number 1, item number 2 and was affirmed as a final order on 27 November 2015, with respect to a workplace located at 10354 S 124th Street, Papillion, NE 68046.
