29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: On or about February 9, 2016, employee not wearing a safety harness with lanyard was exposed to falls greater than 6 feet in height to the ground level below, when working from a Genie aerial lift, while nailing the top plate to the stairway exterior wall.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: Stairway North side of building, employee was exposed to falls greater than 6 feet in height to the ground level below, when working on a platform approximately 24 inches in width, with unprotected side or edge, while framing the stairway exterior wall. The Ricardo Banda was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1000243, citation number 1, item number 1 and was affirmed as a final order on 12/16/14, with respect to a workplace located at 5503 Research, San Antonio, TX.
