29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: (a) On February 2, 2016, at the facility located at 350 E Armour Blvd, Kansas City, MO., the employer did not ensure that all Powered Industrial Truck Operators had successfully completed practical hands on training and that an evaluation of the operator's performance had been conducted. The employer's training program consisted of video tape training only. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.: (a) On February 2, 2016, at the facility located at 350 E Armour Blvd, Kansas City, MO., the employer did not ensure that Mega Touch Force 2003 Powered Industrial Truck found to be in need of repairs had been taken out of service until it was repaired to a safe operating condition in the following instances: (1) Inoperative Emergency Brake (2) Inoperative Horn (3) Inoperative Lights front and back (4) No Slipcover on the Foot Brake (5) No Seat Belt Restraint Device (6) Operator Seat worn or defective (7) Forklift Mast Chain badly rusted Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
