29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  At the jobsite located at 1539 N. Veranda Dr., Wichita, KS; the employer did not ensure employees performing concrete shingle cutting with an abrasive saw wore eye protection. Employees were exposed to the hazard of being struck-by flying debris from the cutting operation.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  At the jobsite located at 1539 N. Veranda Dr., Wichita, KS; the employer did not ensure that the aluminum extension ladder being utilized to access the roof where roofing operations were taking place in that the ladder extended only two feet above the eave and was not firmly attached to the building. Employees were exposed to a fall hazard of up to eleven feet eave to ground.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems or personal fall arrest systems:  At the jobsite located at 1539 N. Veranda Dr., Wichita, KS; the employer did not ensure that employees performing roofing operations on a roof with a  8 in 12 pitch were protected from falling. The employees were exposed to a fall hazard of approximately eleven feet eave to ground.  R Phillips Inc was previously cited for a repeat violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection 315091900, Citation #01, Item #001, issued on 11/15/2011 (Final Order 12/09/2011), with respect to a workplace located at 2130 Cedar Creek, Wichita, KS.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  At the jobsite located at 1539 N. Veranda Dr., Wichita, KS; the employer has not updated the hazard communication program and trained employees on the portion of the hazard communication program that explains the labels on shipping containers and the safety data sheets for items such as but not limited to fuels, caulks and concrete shingles including the order of information and how the employee could obtain and use the hazard information.
