29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   At the jobsite located at 2715 E. Circle Drive in Topeka, Kansas, employees working in the excavation measuring approximately five feet two inches deep were exposed to trip, fall and cave-in hazards in that safe means of egress was not provided.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.   At the jobsite located at 2715 E. Circle Drive in Topeka, Kansas, employees performing excavation and water line installation in the approximately 5 foot 2 inch deep excavation were exposed to struck by and cave in hazards in that the spoil piles were not at least 2 feet back from the edge of the excavation.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:   At the jobsite located at 2715 E. Circle Drive in Topeka, Kansas, employees performing excavation and water line installation in the excavation were exposed to struck by and cave-in hazards in that the excavation and adjacent areas were not inspected by a competent person prior to the start of the work for evidence of situations that could result in possible cave-ins.  The excavation was greater than 5 feet in depth, without a protective system, did not have a safe means of egress, and had spoil piles that were not back at least two feet from the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  At the jobsite located at 2715 E. Circle Drive in Topeka, Kansas, employees performing excavation and water line installation were exposed to struck-by and cave-in hazards in that a protective system was not used. The excavation was approximately forty one feet long by eleven feet wide and ranged in depth from between 5 foot 2 inches to more than 8 feet.
