29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  On or about January 23, 2016, employees used surgical masks instead of organic vapor cartridge respirators for protection against pesticide vapors during application in their worksite, exposing employees to inhalation hazards of Prentox ExciteR and Talstar Professional Insecticides.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used.  On or about January 23, 2016, the employer did not communicate to employees such information as, but not limited to: the required time to isolate employees from exposure during pesticide application in their worksite, the appropriate respiratory protection to be used if entering the building, and the specific hazards of the chemicals, exposing employees to inhalation hazards of Prentox ExciteR and Talstar Professional Insecticides.
