29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a.  On or about February 05, 2016, at the balcony, employees were required to wear a Moldex 2200 N95 particulate respirator while performing forms work or chipping out bad concrete and the employer did not establish nor implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluation, fit testing to the employee, and training on the use, maintenance and care of the respirator.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a.  On or about February 05, 2016, at the balcony, employees were potentially exposed to hazardous materials such as, but not limited to concrete dust containing silica and the employer did not develop nor implement a written hazard communication program.
