29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l) and as referenced by the note contained in 29 CFR 1926.602(d). (29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years): a) Work site - On or about February 11, 2016 and at times prior thereto, an employee operating a rough terrain forklift had last received training and evaluation of his performance in December of 2011, making the evaluation over one year passed due. Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.
