29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent): OR IN THE ALTERNATIVE Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On or about February 1, 2016, for the employee who sustained fatal injuries from a 54 inch fall from a flatbed trailer while preparing stone slabs for delivery at Fabricators Unlimited, 2215 Third Avenue North, Fargo, North Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be for the employer to provide a fall protection system such as but not limited to portable safety guard railings for employees to install from ground level, prior to performing work activities from the top of the flatbed trailers.
