29 CFR 1926.25(b): Safe means were not provided to facilitate removal of combustible scrap and debris at regular intervals during the course of construction: (a)On February 11, 2016, at building #9 at 9589 NW Skyview, Kansas City, MO, employees were exposed to fire and smoke hazards in that combustible scrap and debris including but not limited to sawdust, rags used for stains and thinners, and cardboard waste were allowed to accumulate on floors throughout the building. Ignition sources include but are not limited to discharge of static electricity and electric power tools and spray cans which contained flammable vapors and chemicals. NOTE: Abatement certification is required for this item - use CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

In a multistory building, at least one fire extinguishers was not located adjacent to stairway: (a) On February 11, 2016, at building #9 at 9589 NW Skyview, Kansas City, MO, employees were exposed to fire hazards in that no fire extinguishers were located on the first floor of the building or adjacent to stairways. Flammable and combustible materials used in the building included but were not limited to spray clear coat (toluene, acetone, xylene), thinner (xylene), stain (aliphatic hydrocarbon solvent, ethylbenzene), sawdust, rags used for stains and thinners, and cardboard waste. Ignition sources included but were not limited to discharge of static electricity and electric power tools and sprayers used in the building. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (b) On February 11, 2016, at building #9 at 9589 NW Skyview, Kansas City, MO, employees were exposed to a fall hazard of approximately 10 feet, in that no type of fall protection was in place for a stairwell located in the path of foot traffic between the main building entrance/egress and work areas inside the building. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REAQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
