29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. On or about February 11th, 2016, at the jobsite located at 3230 NW 42nd St, Miami FL 33142, the employer did not implement an effective hearing conservation program for employees who were exposed to noise levels of 140.2% dose or an equivalent sound level of 92.4 dBA. The sampling was performed for 391 minutes and zero exposure was assumed for the un-sampled time of 89 minutes. b. On or about February 11th, 2016, at the jobsite located at 3230 NW 42nd St, Miami FL 33142, the employer did not implement an effective hearing conservation program for employees who were exposed to noise levels of 83.51% dose or an equivalent sound level of 88.7 dBA. The sampling was performed for 354 minutes and zero exposure was assumed for the un-sampled time of 126 minutes. c. On or about February 11th, 2016, at the jobsite located at 3230 NW 42nd St, Miami FL 33142, the employer did not implement an effective hearing conservation program for employees who were exposed to noise levels of 76.31% dose or an equivalent sound level of 88.0 dBA. The sampling was performed for 434 minutes and zero exposure was assumed for the un-sampled time of 46 minutes.

Employees engaged in grinding operations wore N-95 NIOSH approved filtering facepiece respirator or dust mask; and the painter used an MSA Silicone Comfo Classic Half Mask respirator equipped with combination cartridges. The employer did not ensure that a written respiratory protection program was established, implemented and maintained.
