29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: In the workplace located at 912 Seward Street, Omaha, NE 68106 the employer is failing to protect from amputation and struck-by hazards for the following instances: a) Guarding is not utilized to prevent employees from reaching the point of operation, exposing them to amputation hazards while operating the Wysong Model 90-10 mechanical press brake. b) The end sides of the dies are not guarded on Wysong Model 90-10 mechanical press brake, exposing employees to amputation hazards from the point of operation. c) The end sides of the dies are not guarded on the Cincinnati CBII 350 hydraulic press brake, exposing employees to amputation hazards from the point of operation. d) The end sides of the dies are not guarded on the Cincinnati 230PF hydraulic press brake, exposing employees to amputation hazards from the point of operation. e) The Bridgeport mill is not guarded to protect the operator from flying chips.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours: In the workplace located at 912 Seward Street, Omaha, NE 68106 the employer failed to report within twenty-four (24) hours the amputation of three fingers that resulted when an employee crushed their hand in a press brake on or about January 18, 2016. The Omaha Area OSHA Office was notified of the incident the following month by the Nebraska Workers' Compensation Court.
