29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. At the residential construction site, employees were using an aluminum extension ladder with side rails that did not extend at least 3 feet above the edge of the roof. The employees were exposed to a fall hazard of approximately 12 feet.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. Oliver Dimas Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 980022, citation number 1, item number 1 and was affirmed as a final order on July 16, 2014, with a final abatement date of July 21, 2014, with respect to a workplace located at 4008 Melody Pond, Arlington, TX 76005.
