29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about February 16, 2016, at the trenching site located at North May Ave. and 164th in Edmond, OK, an employee was allowed to work in a trench more than 4 feet deep that had no ladder or other safe means access/egress within 25 feet of the employee. The employee was exposed to crushed by and struck-by hazards of collapsing soil.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated: On or about February 16, 2016, at the trenching site located at North May Ave. and 164th in Edmond, OK, a competent person did not conduct daily inspections of a trench to ensure conditions did not exist that could result in possible cave-ins, exposing employees to the hazard of being crushed by falling soil.
