29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment:    a.  Located in the wash bay, employees performed truck tanker pressure washing/drying operations from the top of the tankers while not using fall protection while working on the tankers, thereby exposing the employees to a fall of approximately 13 feet.  On or about January 14, 2016, an employee fell off a 13 foot tanker while not wearing fall protection.       b.  On or about February 17, 2016, located in the wash bay, an employee walked from a gang plank and onto a trucks tanker in order attach a retractable to the employees fall harness without being tied off, thereby exposing the employee to a fall hazard of approximately 13 feet.

29 CFR 1910.23(c)(2): Every runway shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides 4 feet or more above floor or ground level. Wherever tools, machine parts, or materials are likely to be used on the runway, a toeboard shall also be provided on each exposed side. Runways used exclusively for special purposes (such as oiling, shafting, or filling tank cars) may have the railing on one side omitted where operating conditions necessitate such omission, providing the falling hazard is minimized by using a runway of not less than 18 inches wide. Where persons entering upon runways become thereby exposed to machinery, electrical equipment, or other danger not a falling hazard, additional guarding than is here specified may be essential for protection.  a.  On or about February 17, 2016, located in the wash bay, employees performed cleaning and maintenance on bulk trailers under a runway that provided employees access to the top of the trailers.  The approximately twelve foot runway had an eighteen inch section of missing toe board, thereby exposing the employees on the floor to a stuck-by hazard from falling tools/material, equipment, etc.

29 CFR 1910.132(c): Design. All personal protective equipment shall be of safe design and construction for the work to be performed.   a.  On or about February 17, 2016, located in the wash bay, the employer failed to ensure employees performing tank cleaning and drying operations were protected from a fall of approximately 13 feet by using an anchorage point that was capable of withstanding the forces that would be applied to the equipment in the case of a fall.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.    a.  Located in the wash bay, the employer did not verify that a PPE hazard assessment had been performed through a written certification prior to employees performing work with chemicals, at heights, around overhead and high pressure hazards, etc. with the use of PPE.

29 CFR 1910.132(f)(2): Each affected employee shall demonstrate an understanding of the training specified in paragraph (f)(1) of this section, and the ability to use PPE properly, before being allowed to perform work requiring the use of PPE.  a.  Located in the wash bay, employees that worked on the top of bulk tank trailers with fall protection did not demonstrate an understanding of training of when PPE was necessary, how to properly adjust and wear PPE, the limitations of the PPE, proper disposal of the PPE and the ability to use PPE properly prior to being allowed to perform the work, thereby exposing the employees to the hazards associated with a fall from 13 feet.
