29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step: (a) Chick-Fil-A located at 2661 Windy Hill Road, Marietta, GA 30067: Employees were exposed to falls of approximately 11-feet, 5-1/2-inches to the concrete surface below while using the top step of a Werner (Model - NXT1A12) 12-ft. Fiberglass Step-Ladder which is prohibited.

29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the proper use of the scaffold, and the proper handling of materials on the scaffold: a) Chick-Fil-A located at 2661 Windy Hill Road, Marietta, GA 30067: The employer failed to train the operator of a Sky-Jack Scissors Lift on proper use and proper handling of materials while operating this equipment. The employee failed to attach the mid rail chain and was lifting TJI ceiling beams with the top guardrails of the Scissors Lift which is prohibited by the Manufacturer.
